The tour participants acknowledge receiving, reading and agreeing to the terms and conditions set forth below, which sets out a contract between you and China Travel Service (Canada), Inc. (hereafter referred to as CTS). Please read all of the information as the company sets out the conditions covering your travel arrangements. Also, please note that living standards and practice, as well as conditions and standards with respect to the provision of utilities, sanitary services and the grading of accommodation that differ with Canadian standards, may be encountered during your travel to which CTS can not be held responsible.

Deposit: An initial deposit of $500 per person (guarantee of payment) is required at the time of booking, which is non-refundable once a booking is confirmed.

Price: Prices are in Canadian dollars unless otherwise stated and are correct at press time. In the event of any change beyond our control, including but not limited to increases in the price of fuel, currency fluctuations affecting our costs, or increase in government taxes or levies, CTS reserves the right to surcharge the passenger(s).

Cancellation: The passenger must notify CTS of their intention to cancel the travel service. In the event of cancellation by one or more passengers sharing the same accommodation, the rate charged to the remaining passenger(s) will be increased accordingly. If cancellation is received by CTS more than 45 days prior to commencement of services, your deposit will be retained. For individual reservations, the following per person cancellation fees apply:

• 45 – 22 days prior to commencement of service: 25% of total price;
• 21 – 8 days prior to commencement of service: 50% of total price;
• 7 – 1 days prior to commencement of service: 75% of total price;
• On departure day and later: 100% of total price.

Cancellation fees may also apply to any additional services, including accommodations and optional excursions, reserved prior to, during and after the tour. If flight changes, including flight cancellations, are requested, revision fees or airline cancellation fees will apply. CTS reserves the right to cancel or reschedule any tour departure. If cancellation is made prior to the departure of the tour, the only responsibility of CTS will be to refund to the passenger that amount we have received for the tour reservation. We will try to rebook the same tour with a different departure date, or to rebook a similar tour.

Revision Fees: A fee of $50 per transaction will be charged for any alteration or revision made to a reservation. Airline penalties may also apply. A change of traveler name, tour date or tour itinerary within 45 days of commencement of services will be treated as a cancellation and new reservation; standard cancellation fees apply.

Participation: For the benefit of everyone in your vacation, CTS reserves the right to accept or reject any person as a tour participant, and to remove from the tour any participant whose conduct is deemed incompatible with the interests of the other participants.

Form of Payment: CTS accepts personal cheques, certified cheques and money orders. CTS also accept VISA credit cards and a 3% credit card payment surcharge will apply. Authorization for use of a passenger’s credit card for any form of payment indicates your compliance with the terms and conditions set forth by CTS. Final payments are due 45 days prior to commencement of services. A verbal authorization of a passenger’s credit card confirms that a reservation has been requested and once confirmed, CTS reserves the right to cancel any reservations if deposits or final payments are late. In the case of billing errors, we reserve the right to re-invoice with correct pricing.

Unused Services: No refund or adjustment can be made for any portion of the holiday or services which are not used.

Claims & Complaints: Passengers must contact the CTS Representative or pertinent supplier at their destination should they have a problem or concern. Please do not wait until you arrive home. If the matter cannot be resolved at destination the passenger must notify CTS in writing within 30 days of return to point of departure.

Local Conditions: Travelers should be aware that there may be different living standards and conditions with respect to the provision of utilities, services and accommodation outside of Canada. Similarly, standards with respect to the provision and reliability of utilities as well as some services and accommodations may vary and may not be as adequate as would be expected in Canadian facilities. CTS willl not be responsible for any loss, damage, injury or inconvenience resulting from different living standards or any such changes and variations.

Travelers Who Need Special Assistance: You are required to report any disability requiring special attention to CTS at the time during which the reservation is made. CTS will make reasonable attempts to accommodate the special needs of disabled travelers, but is not responsible in the event which it is unable to do so, nor is CTS responsible for any denial of services by carriers, hotels, restaurants, or other independent suppliers. We regret that we cannot provide individual assistance to a tour participant for walking, dining, entering and existing motor coaches and other vehicles, or other personal needs. A qualified companion must accompany travelers who need such assistance.

Visa & Passport: It is the sole responsibility of the passenger to ensure proper and valid documentation. Please check with your travel agents for the latest requirements, as your failure to provide valid documentation may result in denied boarding of the aircraft and cancellation of your flight arrangements without refund. Most countries require the passport be valid for  6 month beyond the conclusion of your trip.

Taxes & Service Charges: CTS price tables include all hotel taxes and service charges in the prices shown. Local tourism and departure taxes and the Goods & Services Tax are not included and will be added to your invoices.

Safety: Please be aware that during your participation in tours operated by CTS, certain risks and dangers may arise beyond our control including, but not limited to, the hazards of traveling in developing areas; travel by boat, train, automobile, aircraft or other means of transportation; the force of nature, political unrest and accident or illness in remote regions without means of rapid evacuation or medical facilities. CTS will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. It is understood that CTS will use its best efforts to ensure that adequate measures are taken.

Responsibility: China Travel Service (Canada), Inc. Toronto Office. 100 Sheppard Avenue, Suite 780 Toronto Ontario Canada M5G 2K8  and Vancouver Office - 1245 West Broadway, Suite 102 Vancouver, British Columbia Canada V6H 1G7 are responsible to you in making arrangements for the tour services offered by our travel agents, including transportation, sightseeing, and accommodation.

The carriers, accommodations, and other suppliers providing tour services are independent contractors and are not agents, employees, or servants of, or joint ventures with, CTS or its affiliates. All certificates and other travel documents for tour services issued by CTS are subject to the terms and conditions specified by the supplier, and to the laws of the countries in which the services are supplied.

If, after tour departure, the services included in the tour cannot be supplied, or there are changes in an itinerary for reasons beyond the control of CTS, CTS will arrange for the provision of comparable services. Any resulting additional expenses will be payable by travelers and any resulting savings will be refunded by CTS to tour participants.

The tour participant agrees that neither CTS nor its affiliates shall be liable for any damage, loss (including personal injury, death, and property loss) or expense occasioned by any act or omission of any supplier providing tour services, any insurer or insurance administrator under the Travel Insurance, or of any other person(s).

Neither CTS nor any affiliate shall in any case be liable for other than compensatory damages, and you hereby waive any right to punitive damage.

No person, other than an authorized representative of CTS, by a document in writing, is authorized to vary, add, or waive any term or condition, including any term or condition set forth in the preceding provisions.
